Last year, the IPAT Clinic was invited to present on fair use to the California Conference of the American Association of University Professors. In March, IPAT Certified Law Students Oluwatobi Agbelemose and Kristina Martinez, together with Clinic Director Jack Lerner, led a workshop at the CA-AAUP’s annual meeting. We discussed important fair use concepts like its relationship to the First Amendment; transformative use; relevant statements of best practices in fair use; and the Digital Millennium Copyright Act’s triennial rulemaking process that allows university professors to make fair use.
We especially enjoyed when the students became the teachers and “quizzed” the participants on fair use by presenting the facts of real-world cases, having the participants break into small groups to discuss, and then polling them on the results.
The workshop was a success and we look forward to further collaboration with the academic community on fair use issues.
