IRVINE, Calif. (April 17, 2023) – UCI Law Professor Susan E. Seager and students with the UCI Press Freedom Project (PFP) at the University of California, Irvine School of Law have filed a motion on behalf of journalist Ben Camacho to dismiss the City of Los Angeles’ unconstitutional and retaliatory lawsuit against him.
Mr. Camacho is a reporter for Knock LA, a non-profit news website based in Los Angeles. His work focuses on policing issues in Southern California. This is not the first time the PFP has worked with Mr. Camacho. Previously, PFP had filed a successful Public Records Act lawsuit on behalf of Mr. Camacho against the City of Santa Ana for the disclosure of body cam footage and other police records.
In September 2022, Mr. Camacho obtained and published photographs of LAPD officers through another successful Public Records Act lawsuit. He requested these records in effort to inform the public about the identities of police officers working in public. Under the First Amendment, the public has significant interest in being able to identify police officers who patrols their neighborhood, who arrest protestors and journalists, and who refuses to provide their names, badges, or serial numbers when on duty and interacting with the public.
The City of Los Angeles responded by filing the lawsuit against Mr. Camacho, seeking to both suppress his First Amendment rights and to curtail the public’s access to important public records. The City claims that it made a mistake and inadvertently included photographs and names of some officers who work in “sensitive assignments.”
“Similar to other CPRA requests I’ve made in the past, I requested these records to advance my work, including documentary filmmaking and investigations into policing in Los Angeles,” said journalist Ben Camacho. “Access to police records brings transparency and awareness to the otherwise secret inner workings of the LAPD, an organization that receives billions of dollars from the public.”
“The City of Los Angeles should not be able to restrict Mr. Camacho’s First Amendment right,” said PFP second-year student, Shan Wen. “By suing Mr. Camacho for records that were already disclose, the city set a dangerous precedent that could hinder journalists’ work in keeping the government accountable and transparent.”
“This lawsuit is likely another example of the City of Los Angeles bending to the whims of the LAPD. It won’t work,” said PFF second-year student, Leon He.
In their motion, Mr. Camacho and his attorneys ask the Court to strike the City’s Complaint, effectively dismissing the meritless case against him. Mr. Camacho alongside his attorneys and the students of PFP will continue to fight to protect his First Amendment rights and keep these records public.
